Terms of Service

1. The service

DataMintify is a Shopify application that automatically enriches food product listings with nutrition facts, ingredient lists, allergen information, and AI-generated product descriptions. The service is provided via the Shopify App Store and operates as an embedded app within your Shopify admin.

2. Eligibility

You must have an active Shopify store and be authorised to install apps on behalf of that store. By installing DataMintify, you confirm that you have the authority to agree to these terms on behalf of your business.

3. Billing

DataMintify is billed through Shopify. Charges appear on your regular Shopify invoice. Plans are subscription-based with a monthly billing cycle. Overage charges apply when enrichments exceed your plan's included allowance. All pricing is displayed within the app and on our pricing page. We reserve the right to change pricing with 30 days' notice to active subscribers.

A 30-day free trial is offered to new merchants. No credit card is required during the trial period. After the trial, you must be on a paid plan to continue enriching products.

4. Acceptable use

You agree not to:

• Use DataMintify for any unlawful purpose or in violation of Shopify's Terms of Service.
• Attempt to circumvent billing, abuse free trial access, or create multiple accounts to avoid charges.
• Reverse-engineer, scrape, or extract data from the DataMintify service.
• Publish enrichment data that you know to be inaccurate or misleading to customers.

5. Enrichment data accuracy

DataMintify retrieves nutrition, ingredient, and allergen data from third-party food databases. While we take care to source data from reputable providers and cross-reference multiple sources, we do not guarantee the accuracy or completeness of any enrichment result. You are responsible for reviewing enriched data before it is published to your storefront. DataMintify should not be relied upon as the sole basis for food labelling compliance without independent verification.

6. AI-generated content

AI-generated product descriptions are produced by large language models and may occasionally be inaccurate, incomplete, or unsuitable for your brand. You are responsible for reviewing and editing AI-generated content before publishing it to your store.

7. Data and privacy

Our handling of your data is described in the Privacy Policy. By using DataMintify, you agree to the Privacy Policy. When you uninstall the app, all store-specific data is immediately and permanently deleted.

8. Intellectual property

DataMintify, its interface, and underlying technology are owned by Opticfolio Limited. You retain ownership of your store's product data and any content you publish to your Shopify store. AI-generated descriptions produced for your products are yours to use freely.

9. Limitation of liability

To the fullest extent permitted by law, Opticfolio Limited shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of DataMintify. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

10. Termination

You may terminate your subscription at any time by uninstalling the app from your Shopify admin. We may suspend or terminate access if you breach these terms. Upon termination, billing stops and your data is deleted as described in the Privacy Policy.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these terms

We may update these terms from time to time. Continued use of DataMintify after changes constitutes acceptance of the updated terms. For material changes, we will notify active merchants via email at least 14 days in advance.
